Administrative Law

Administrative law lawyer in Pakistan for writ petitions, judicial review of government action and service tribunal matters. Free consultation.

Lawyer Services Pakistan represents individuals and businesses challenging government decisions through writ petitions, judicial review and service tribunal proceedings. If a government department has acted outside its authority, or a decision affecting you was made without due process, there may be a remedy, but it has to be pursued correctly and without delay.

A decision is not final just because it came from a government department. Pakistani courts can review administrative action that is unlawful, procedurally unfair or outside the decision-maker’s legal authority.

What we handle

  • Writ petitions under Article 199. Challenging the actions or decisions of government departments, statutory bodies and public office holders before the High Court.
  • Judicial review of administrative action. Testing whether a decision was made within legal authority, with fair procedure, and in line with the rules governing the decision-maker.
  • Government service matters. Representing government servants in disputes over postings, promotions and disciplinary action, including matters that go to Service Tribunals rather than the ordinary courts.
  • Regulatory and licensing disputes. Challenging refusals, suspensions or conditions imposed by regulatory and licensing authorities.

A limit worth knowing before you file

Courts generally do not interfere with decisions made within a department’s ordinary discretion where no clear violation of law is shown. A writ petition is more likely to succeed where there is an identifiable legal defect: acting outside authority, denying a fair hearing, or ignoring the decision-maker’s own rules. Delay can also count against a petitioner. We assess this honestly before filing rather than filing a petition that is unlikely to succeed. Administrative Law: FAQs

What is a writ petition?

A writ petition is a constitutional remedy filed in the High Court under Article 199 of the Constitution. It seeks an order against a government department, statutory body or public official that has acted unlawfully, exceeded its authority or denied due process.

Can any government decision be challenged through a writ petition?

No. Courts generally do not interfere with decisions made within a department’s ordinary administrative discretion. A writ petition is more likely to succeed where there is a clear legal defect, such as lack of authority, procedural unfairness or a decision contrary to the rules that govern it.

What’s the difference between a writ petition and a service tribunal case?

Disputes involving the terms and conditions of government servants, such as postings, promotions and disciplinary action, are often heard by Service Tribunals rather than as ordinary writ petitions. Which route applies depends on the subject matter and the service rules involved.
